The Public Agency and Water Law practice group has extensive appellate and civil trial experience in state and federal courts and has assisted municipalities, water districts, industry, land owners and others who require public agency or municipal law advice.

Robert Nacionales Tafoya chairs the Public Agency and Municipal Law practice at Tafoya & Garcia. Mr. Tafoya has represented public officials such as Richard Melendez (Mayor of West Covina) and Assemblymember Roger Hernandez, among others. In addition, Mr. Tafoya has represented municipalities and public agencies such as the Water Replenishment District (WRD).

Water Rights and Water Law

Tafoya & Garcia is at the forefront of water issues affecting California. Our lawyers have represented public entities in a number of major water rights matters.

Tafoya and Garcia successfully represented the Water Replenishment District against the Central Basin Municipal Water District in a case involving certain rights implicating the Central Basin.

Tafoya and Garcia then assisted the WRD in getting legislation passed to codify WRD's exclusive right to replenish the water tables in its jurisdiction.

Employment Discrimination/Wrongful Discharge Litigation

Tafoya & Garcia works with clients across the country in all aspects of employment litigation, including trials in cases arising under Title VII of the Civil Rights Act of 1964, the Civil Rights Act of 1991, the Equal Pay Act, the Age Discrimination in Employment Act, the Americans with Disabilities Act of 1990, the Family and Medical Leave Act of 1993, the Fair Labor Standards Act, the WARN Act and other federal and state laws regulating the workplace.

Tafoya & Garcia represents numerous clients before governmental agencies, including the Equal Employment Opportunity Commission, the Office of Federal Contract Compliance Programs, and the California Department of Fair Employment and Housing. We frequently represent clients during pre-litigation investigations and any litigation involving discrimination and harassment claims.

Wage and Hour Matters

The Fair Labor Standards Act and state law often imposes multi-level obligations on the employer, and violations of such laws can result in substantial liability. These disputes typically involve evidence related to hours worked and the nature of an employee’s job duties. Tafoya & Garcia possess unparalleled experience and have a track record of succesful litigation results. Tafoya & Garcia lawyers have interviewed literally thousands of employees to collect evidence for the resolution of and defense of many wage and hour disputes.

We can provide advice on avoiding wage and hour class actions at any stage in this process. We work closely with clients preparing policies on overtime and salary pay, determining which activities constitute compensable services under the law, and reviewing job duties to determine which employees qualify for overtime under federal and state law. We often represent clients during investigations by state and federal agencies.
